18 U.S.C. § 2257 Statement

Exemption: Content Produced by Third Parties

For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content depicting explicit sexual conduct, real or simulated, posted on the website. Regarding such, the operators of niceass.pics restrict their undertakings to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is contributed by third-party users of the website. All user-supplied content appearing on niceass.pics results from the actions of third-party users, who have control of areas of the website that contain the content. For this reason, the operators and owners of niceass.pics are exempt from compliance with Section 2257 records keeping and labeling obligations as expressed in 28 C.F.R. §75.1(c)(4). Should any content on niceass.pics be thought to be illegal, unlawful, harassing, harmful, offensive or otherwise unacceptable, the website reserves the right, at the operator’s sole discretion, to remove said content from the site immediately in accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).
